Csuki Terms of Service

These Terms of Service ("Terms") govern your access to and use of the csuki mobile application, website, and related services (collectively, the "Service") provided by Adrian Kuttesch ("csuki," "we," "us," or "our").

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.


1. About the Service

csuki is a public transport information service that may provide features such as route information, station information, vehicle positions, estimated arrival times, timetables, maps, alerts, and related content.

The Service is provided for general informational convenience only. Public transport data may be delayed, incomplete, inaccurate, or unavailable from time to time.


2. Eligibility

You may use the Service only if you are legally able to enter into a binding agreement under the laws applicable to you.

If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement or permission of a parent or legal guardian.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service for your personal, non-commercial use.

csuki does not operate public transport services unless explicitly stated otherwise.

Information shown in the Service may come from third-party sources, including transit operators, map providers, infrastructure providers, analytics providers, advertising partners, and other external sources. We do not guarantee that route data, station data, timetable data, vehicle positions, estimated arrival times, service notices, or map content will always be accurate, complete, current, or available.

You are responsible for independently verifying critical travel information where needed. You should not rely on the Service for emergency, safety-critical, or mission-critical decisions.


5. Ads and Subscription Features

The Service may include advertising.

The Service may also offer a paid subscription or purchase option that removes or reduces advertising or unlocks certain features ("Premium Features"). If offered, subscription details, pricing, billing cycle, and included benefits will be shown to you before purchase.

By using the Service, you acknowledge that we may collect, use, store, and share information as described in the Privacy Policy.

"csuki" and related names, logos, and branding are our property or used under license. You may not use them without prior written permission.

Third-party names, logos, maps, transport data, or trademarks appearing in the Service remain the property of their respective owners.

The Service may integrate with or link to third-party services, such as map services, analytics tools, crash reporting tools, advertising networks, payment processors, app stores, and transit-data providers.

We are not responsible for third-party services, content, policies, or practices. Your use of third-party services may be governed by separate terms and privacy policies.


11. Availability and Changes

We may modify, suspend, discontinue, or restrict all or part of the Service at any time, with or without notice, to the fullest extent permitted by law.

We may also update the app, change features, fix bugs, add or remove functionality, or impose reasonable limits on access or use.

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis.

We disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade.

Without limiting the above, we do not warrant that the Service will be uninterrupted, secure, error-free, accurate, complete, reliable, current, or compatible with all devices and operating systems.


13. Limitation of Liability

To the maximum extent permitted by law, we and our affiliates, officers, directors, employees, contractors, licensors, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, business opportunities, or anticipated savings, arising out of or related to your use of or inability to use the Service.

You may stop using the Service at any time by uninstalling the app and discontinuing use.

We may update these Terms from time to time. The updated version will become effective when posted in the Service, on our website, or otherwise made available to you, unless a later date is stated.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms.

These Terms are governed by the laws of Romania, excluding its conflict of laws principles, unless mandatory local consumer law requires otherwise.

Any dispute arising out of or relating to these Terms or the Service will be resolved by the competent courts of Romania, unless applicable consumer law gives you the right to bring claims in another court.

If you are a consumer in the European Union, you may also have rights under mandatory consumer protection laws that cannot be waived by these Terms.


19. App Store and Marketplace Terms

If you downloaded the app through Apple App Store, Google Play, or another marketplace, you acknowledge that those platforms are not responsible for providing maintenance and support for the Service except as required under their own terms or applicable law.

Your use of the app may also be subject to the applicable marketplace's terms, conditions, and policies.
